Terms of Service
These Terms of Service (“Terms”) govern your use of the Footprints to Feel Better website and your engagement of counseling and/or coaching services from Footprints to Feel Better (“we,” “us,” “our,” or the “Practice”). By using our website, scheduling an appointment, or receiving services, you agree to these Terms. If you do not agree, please do not use our website or services.
1. Description of Services
Footprints to Feel Better offers two distinct categories of service, and it is important to understand the difference:
- Mental health counseling: Provided only by staff who hold an active, valid license to practice mental health counseling, social work, or a related licensed profession in New York State. Licensed counseling services involve the assessment, diagnosis (where applicable), and treatment of mental health conditions and are subject to professional licensing standards, clinical recordkeeping requirements, and HIPAA.
- Wellness / life coaching: Provided by coaching staff and is not a substitute for licensed mental health treatment, diagnosis, or therapy. Coaching does not involve diagnosis or treatment of mental health conditions and is not billed to health insurance.
We will clarify, at intake, which category of service you are receiving. If your needs are more appropriately addressed through licensed counseling, we will let you know and, where appropriate, refer you accordingly.
2. Not for Emergencies
Our services, including telehealth, are not appropriate for emergencies. If you are experiencing a medical or psychiatric emergency, are in crisis, or are at risk of harming yourself or others, call 911, go to your nearest emergency room, or call/text the 988 Suicide & Crisis Lifeline. We may not be reachable outside of scheduled sessions or normal business hours.
3. Eligibility
You must be at least 18 years old to agree to these Terms on your own behalf, or the parent/legal guardian of a minor client providing consent on the minor’s behalf, and you must be physically located in a jurisdiction where we are authorized to provide services (generally New York State for telehealth) at the time of any session.
4. Scheduling, Cancellations, and Fees
- Appointments must be scheduled in advance through our intake process or booking system.
Fees are due at the time of service unless other arrangements have been made in writing. We use a third-party payment processor to handle transactions; we do not store your full payment card information.
5. Telehealth Consent
If you receive services via telehealth, you acknowledge that: (a) telehealth involves the use of video/audio technology and carries inherent risks, including possible technical failures and limits on confidentiality of electronic transmission; (b) you are responsible for ensuring you are in a private location for sessions; (c) telehealth may not be appropriate for all conditions, and your provider may recommend in-person care if clinically necessary; and (d) you may withdraw consent to telehealth at any time.
6. Client Responsibilities
- Provide accurate information during intake and throughout treatment or coaching.
- Attend sessions on time and notify us promptly of any need to reschedule or cancel.
- Understand that outcomes from counseling or coaching cannot be guaranteed.
7. Confidentiality
Confidentiality of clinical information is governed by our HIPAA Notice of Privacy Practices, applicable New York State law, and professional ethical standards. Coaching communications that do not constitute clinical treatment records are handled under our Privacy Policy. Certain disclosures may be required or permitted by law even without your consent (for example, mandated reporting of suspected child or vulnerable-adult abuse, or imminent risk of serious harm), as further described in our HIPAA Notice of Privacy Practices.
8. Intellectual Property
All content on our website, including text, graphics, logos, and materials provided during services, is the property of Footprints to Feel Better or its licensors and may not be reproduced or distributed without permission, except for your personal, non-commercial use in connection with your own care.
9. Disclaimers
Our website and any general educational content we provide are for informational purposes only and do not constitute medical or psychiatric advice, diagnosis, or treatment, and do not establish a clinician-client relationship. A clinician-client or coach-client relationship is formed only upon mutual agreement to begin services following intake.
10. Limitation of Liability
To the fullest extent permitted by law, Footprints to Feel Better, its owners, employees, and contractors shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or services, except where such limitation is prohibited by law or in cases of gross negligence or willful misconduct.
11. Termination of Services
Either party may end the service relationship at any time. We may decline to continue services or make an appropriate referral if we determine, in our professional judgment, that continued services are not clinically appropriate, safe, or in your best interest, or in the event of non-payment, subject to applicable professional and ethical obligations regarding continuity of care.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising from these Terms or our services shall first be addressed through good-faith discussion between the parties.
13. Changes to These Terms
We may revise these Terms from time to time. The “Effective Date” above reflects the most recent revision. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.
